浅析网络环境中的媒介审判

摘要:随着互联网技术的发展,多数人的意见无论对错都通过网络环境更快的传播并反作用于社会,极易造成媒介审判。本论文首先对媒介审判的概念进行界定,并论述其发展现状,其次分析媒介审判的负面影响,如媒介审判影响司法独立、媒介审判妨碍司法公正、媒介审判导致新闻侵权等。随后本文着重分析媒介审判产生的原因,如社会矛盾凸显、媒体越位、司法审判公开制度不健全等,并针对上述原因提出合理化建议,如媒介遵循客观报道规律、提高媒体从业者的法律素养、加强网民媒介素养教育、增强司法透明度等。5788

On the Media work Environment
Abstract: With the development of technology, no mater the opinions of the most people whether right or wrong are spread rapidly work environment and react on the society, that’s easy to cause the media trial. At first, this article define the concept of media trial and discuss the current situation of the development .Secondly, it analyses the negative effect of media trial, for instance, media trial influences the judicial independence, media trial obstructs the judicial fairness,media trial causes the news infringement,, this article emphatically analyses the reasons of the media trial, such as the social contradictions are prominent, media offside, the public system of judicial adjudication is unsound, etc. And then aims at these reasons , this article puts forward reasonable Suggestions, for example, medium should follow the law of objective reporting, improve the legal plishment of media practitioners, strengthen citizen’s media literacy education and enhance the judicial transparency, etc.
综上所述,“媒介审判”实际上是掌握着引导受众正确舆论和对司法机关实行监督权的媒体的一种越权行为。“媒介审判”是新闻媒体通过片面失实的报道来影响受众的舆论,以此来对案件做出先于司法机关的审判,对涉案人员对出定性、定罪、定刑以及胜诉或者败诉等结论。
(二)网络环境中媒介审判现状概述
世界上第一例“媒介审判”案件是美国的“谢帕德案件”。1954年6月4日美国的外科医生谢帕德被指控是谋杀自己妻子的凶手。在当时的情况下,案发现场没有留下线索,使案情无法展开调查,但媒体和民众通过合理想象认定他是杀害妻子的凶手。媒体对于案件进行炒作,不断地制造噱头,通过新闻使受众认定他杀妻罪名成立,在这种情况下,法院最终判决谢帕德有罪。谢帕德每年都上诉,直到12年后才上诉成功,法院改判判其无罪。
中国第一例“媒介审判”案例是“张金柱案”。1997年8月24日晚,张金柱开车撞飞了骑车的少年并拖行另一个骑车人数米。在当时媒体报道了张金柱的官员身份,进行炒作,提前对其“审判”,他的身份激起了民众的愤怒,法院判决张金柱死刑。张金柱死之前说自己是死在记者的手里。由此“媒介审判”开始进入国人的视线中,随着十几年的发展,“媒介审判”越来越多,尤其是随着互联网的发展,也出现了网络环境中的媒介审判。
