预付式消费法律制度研究
摘 要
近年来,预付式消费带来的问题日渐显现。由于预付式消费的特殊性,使得消费风险高于一般消费,预付式消费纠纷更已成为消费投诉的“重灾区”。而同时,我国相关立法的相对滞后,使得我国预付式消费者权益保护日益维艰,因此,加强对预付式消费者权益保障的研究十分必要。
目前,我国学者对预付式消费的研究已日渐趋多,本文主要对预付式消费的定义、我国现行规范保障、各国立法经验、各地规范措施、立法建议等方面进行了综述,在此基础上阐述对我国预付式消费法律制度的构想。
本文的第一部分主要进行预付式消费概述,包括预付式消费的发展状况分析,预付式消费的含义、特点、类型及其合法性及合理性的研究,同时,对预付式消费的主要表现形式进行概述,在预付式消费卡、代币券、特殊兑换券的含义分析的基础上, 着重分析这几种消费形式的发展及现有法律制度。本文第二部分对预付式消费的风险及制度缺陷进行研究。包括预付式消费现状及风险分析,最新预付式消费立法动态及我国的制度缺陷。本文第三部分主要阐述了各国预付式消费立法考察,以期对我国的预付式消费法律体系的建立有所借鉴。本文第四部分从预防及救济两方面提出了对预付式消费监管制度完善的总体构想。

Research On Prepaid Consumption Legal System
Abstract
In recent years, the problems are emerging with the further development of prepaid consumption. Due to the particularity of the prepaid consumption, consumption take more risk and meanwhile the prepaid consumption disputes have already became plaints' hardest- hit area. At the same time, the lacking of legislation makes our country's prepaid consumer right protection into mess up. So it's very necessary to do a research about how to strengthen the prepaid consumer right protection.
At present, Chinese scholars' study of prepaid consumption has increasingly increased. In this paper, we are focusing on the definition of prepaid consumption, Chinese currently specification security system, various countries legislative experience and the local regulations, the legislative proposals and so on as a overview, then putting forward the concept of our country's prepaid- consumption-legal-system on this basis.
The first part of this article is to summarize the prepaid consumption, including state of development of prepaid consumption analysis, the study of the meaning, characteristics, types and its legitimacy and rationality of the prepaid consumption.
