施工索赔原因分析及其处理原则探讨
摘要:在建设项目管理过程中,施工阶段是项目投资额最大、管理最复杂,能否实现项目管理目标的关键环节,业主如何做好施工阶段的索赔预防和处理工作将直接关系到工程项目管理目标的实现。本文主要分析了施工索赔产生的原因及其处理原则,研究的内容主要包括:(1)国内外关于施工索赔方面的研究现状以及本文的研究目的;(2)从不同角度论述了施工索赔的分类和施工索赔产生的原因,为后文论述工期索赔和费用索赔提供了基础;(3)分别讨论了工期索赔和费用索赔的产生的各种原因及计算方法,并指出两者之间存在一定的可替换关系,并利用案例对相关结论进行了验证。

施工索赔问题的产生
施工索赔是指在施工合同履行过程中,根据法律、合同规定及惯例,当事人一方由于另一方未履行合同所规定的义务或者出现了应当由对方承担的风险而遭受实际损失时,通过一定的合法程序向对方提出给予补偿要求的行为。施工索赔是一种正当的权利要求,是业主维护在工程发包施工中合法利益的一项根本性管理措施。20世纪80年代中期云南鲁布革引水发电工程首次采用国际招标和按国际惯例进行管理项目,“索赔”一词自此开始进入中国。随着我国加入WTO,对外开放进程加快,涉外工程也越来越多,我国的建筑市场正从传统的计划经济走向开放的市场经济,并逐步与国际接轨。建筑产品价格的确定方式从传统的预算价格转向以招标投标方式确定价格,结算方式也从传统的施工图预算加签证的方式转变为合同价加索赔款的方式。基于这种状况,建筑工程中的索赔问题逐步成为工程项目管理工作中的热门话题,受到广泛关注。
国内外的现状
在国际工程的承包施工中,国际上已形成了几个比较国际性、通用性和权威性的合同条件,如国际咨询工程师联合会(FIDIC)编制出版的《土木工程施工合同条件》;美国建筑师协会制定的AIA合同条件;英国土木工程师学会编制的NCE合同条件;世界银行发布的《工程采购招标文件样本》等。这些合同文本在多年的
