摘要
我国是世界上的人口大国,这也就决定了我国的烟草制品的生产和消费量很多,烟
草行业是我国经济中的一个重要行业。我国对烟草制品实行垄断经营主要是因为卷烟市
场在我国经济中的特殊地位以及烟草制品的特殊性。我国在《烟草专卖法》中规定目前
我国对烟草制品实行中有计划的经营和生产,对烟草制品实行统一的管理以及垄断的经
营,有计划的对烟草产品的销售、生产和进出口业务进行管理。但是,在我国目前实行
烟草专卖体制的情况下,烟草专卖受到体制的限制以及我国现行行政执法状况的制约,
在我国的烟草专卖执法过程中的风险不断发生,严重扰乱了烟草行业的健康发展,也为
我国的行政执法带来了挑战,因此对烟草专卖行政执法进行风险防控十分必要。
因此,本文通过分析行政执法的一般理论,实现对烟草专卖行政执法风险的深入剖
析,依据烟草专卖行政执法的法律规范,借鉴一般行政执法的实践经验,提出通过提高
烟草专卖的专业行政执法水平,有效防控烟草专卖行政执法风险的措施。
本文除引言和结论外,正文共分为四大部分,共计 3 万余字。
第一部分对烟草专卖行政执法风险防控的理论进行了简要分析,并说明了研究烟草
专卖行政执法风险防控的必要性。第二部分主要论述了当前烟草专卖行政执法风险的几
种表现,以及风险存在的原因。第三部分主要阐述了英国、美国和日本等发达国家在行
政执法方面的法律规定,并且笔者在文章最后一部分借鉴了这些国家的先进做法,对我
国行政执法的改革提出了合理建议。
