城市房屋征收补偿标准研究

随着市场经济的快速发展和城市现代化步伐加快,城市建设中房屋征收拆迁也大大增加。在现实中,绝大多数被拆迁户与开发商和行政机关的矛盾,主要集中在征收拆迁房屋的补偿标准上:被拆迁户认为征收拆迁补偿标准太低,而开发商和行政机关认为拆迁户“漫天要价”。由于在征收拆迁补偿标准上双方分歧较大,矛盾经常因此而发生, 暴力拆迁或者极端事件等成为社会的焦点。
2011 年制定的《国有土地上房屋征收与补偿条例》(简称征收补偿条例)对城市房屋征收拆迁标准规定不得低于房屋征收决定公告之日被征收房屋类似房地产的市场价格。不能适应于多变的社会矛盾,解决征收补偿具体的情况。
因此本文首先就城市房屋征收补偿标准原因深入分析,在比较研究美国、德国征收补偿标准的基础上,揭示我国在确定城市房屋补偿标准的困境,结合我国城市房屋征收与补偿的实际,建议应以市场价值为基本多种评估方法并存,裁执分离,执行权归属行政机关的补偿标准来构建我国的城市房屋征收补偿标准。本文主要由以下三部分组成: 第一部分关于城市房屋征收补偿标准的概述,具体分析城市房屋征收补偿标准的原因。从国外自然法学到近代征收补偿原因,再到我国法律法规关于再到我国法律法规关
于征收补偿原因的规定,揭示不同时期我国确定的城市房屋拆迁补偿标准的不同。第二部分比较研究美国、德国关于城市房屋征收补偿标准的具体规定,美市
场价值的城市房屋补偿标准和德国全额补偿标准两种城市房屋补偿的比较。接着讲我国征收补偿标准的承继外国行政法的发展进程与德国、美国的不同点。
第三部分具体讲我国城市房屋征收补偿标准的缺陷与完善。通过对我国城市房屋征收补偿标准的分析,指出我国城市房屋征收中被征收房屋的价值的评估方法的不足,搬迁费和临时安置费及停产停业损失的计算缺陷以及司法强制执行权的错位。同时,完善方案从城市房屋征收补偿的运作的程序进行完善。从参与其程序的主体、运作的机制和补偿救济进行完善征收补偿标准。

Abstract
With the rapid development of market economy and the acceleration of modernization in the city, city construction on the house also increase greatly. In reality, most of the site was with developers and ans of the contradiction, mainly concentrated in the collection of the houses demolished pensation standard: was that tear open pensation standard collection site is too low, and the developers and ans of the site that "too much".
