真的存在“双重标准”,还是混淆视听
摘要:从专利授权进度的影响因素分析视角,对相同时期、相同技术领域的Dyson公司、中国申请人和国外申请人的中国获权发明专利进行了分析,得出影响专利授权进度的因素更多的在于申请人的专利申请策略尤其是申请时间策略的结论。分析结果表明,在针对中国的专利申请时间策略中,Dyson公司和国外申请人整体上都存在大量的、有意识的时间延误,中国申请人更积极快速的配合专利局,国外申请人则不然。专利申请人的时间策略选择和申请人与审查员的互动行为表现,最终导致专利授权进度的差异。申请人James Dyson关于中国专利局存在双重审查标准、差异对待本国申请人和外国申请人的言论没有真实、客观和准确的依据,意欲混淆视听、不负责任的表现。

Is there real ‘double standard” in patent examination in China, or just ment and critique?
Abstract: Analysis is carried on influencing factors in the patent grant procedure over James Dyson’s Corporation, Chinese and foreign applicants from the same technology during the same period. Analysis result shows the applicant's patent application strategy affects the procedure most, with time strategy being the most important factor. In real world, foreign applicants including James Dyson Firm behave much intentional prosecution delay while Chinese counterparts interact with China Patent Office as quickly. It’s patent applicants’ factual time strategy choice and interaction behavior with patent examiners during the process in patent examination procedure that result and lead to the final difference in patent grant procedure e. With clear understanding of affecting factors in patent examination procedure, James Dyson’ment on patent examination in China declaring Double Standard over Chinese and foreign applicants is just confusing and mistaken critique concluded on anecdote but no actual evidence.
