论交通肇事罪的认定及立法完善

摘要:交通肇事罪是日常多发犯罪之一,对人民群众的生命财产安全造成了极大的危害,对本罪进行全面的研究对于增加公众的交通安全知识,加强驾驶人社会责任意识具有重要的现实意义。本文在诸多学者对交通肇事罪理论研究的基础上,运用比较和历史的方法,结合自己的观点及新近发生的案例,对交通肇事罪的认定以及与相关犯罪的区分进行了简单的探讨,并就交通肇事罪中自首的认定问题加以重点阐明,另对现阶段在我国设立危险驾驶罪作了简要的分析,最后对交通肇事罪的立法司法走向进行了瞻望。
