医疗事故的责任程度—法医鉴定30例分析
【摘要】目的研究医疗事故鉴定中责任程度的判定。方法通过对30例医疗纠纷案件鉴定资料的回顾性研
究和统计分析,分析医疗过失、疾病对不良后果的参与度,确定责任程度大小。结论在医疗事故鉴定过程中,需要特
别注意疾病因素对不良后果的影响,这对判定责任程度很重要。

材料、方法和结果表3。
本组案例选自2000年4月~2003年10月西安交
通大学医学院临床法医学教研室鉴定的案例,所有鉴定
均由法院委托,共30例。

、被鉴定人性别分布
30例医疗纠纷案件中,男性18例,女性12例,分
别占60%和40% 。
二、被鉴定人年龄分布
30例医疗纠纷案件中,年龄最小的2岁1个月,最
大的81岁(表1)。

三、30例医疗纠纷案件的鉴定结果
30例医疗纠纷案件中,死亡6例,活体24例,分别
占20% 和80%。活体中有7例同时要求鉴定伤残等
级,依照《职工工伤与职业病致残程度鉴定标准》,对这
7例进行了伤残评定,结果,四级伤残2
