[摘要] 日趋严重的大学生犯罪问题的一个重要特点,就是犯罪加害人与犯罪被害人同时为在校大学生的案件占有很大比例。因此,借鉴现代被害人学的理论成果,深入研究当今大学生作为潜在犯罪被害人自身存在的被害条件,全面揭示大学生的刑事犯罪被害性,并针对性地制定和落实大学生犯罪被害预防措施,是有效预防和减少大学生犯罪现象的重要途径。

Abstract:The problem of criminal offences of college students es increasingly serious. An important characteristic is that both criminals and victims are college students which account for a large proportion of the cases. Thus, by borrowing the theoretic achievement of modern vitimology and giving a deep study on the victim condition which exists in the potential victim himself, this paper tries prehensively reveal the victimity of collgee students’ criminal offences, and develop the measures specifically pertinent to college students for prevention of victimization, which will be an important approach to effectively provent and reduce criminal offences of college students.

大学生是具有较高文化素质的特殊群体,他们肩负着建设祖国的重任,是国家的栋梁和未来。但是,在构建社会主义和谐社会的今天,屡屡发生在在校大学生身上的种种犯罪现象,不仅与高等学校人才培养目标格格不入,也严重损害了“天之骄子”的身心健康和成长。据北京市公安局海淀区分局的统计,,大学生犯罪人数同比上升282%[1]。然而,值得注意的是,在所有这些大学生犯罪案件中,犯罪加害人与犯罪被害人同时为在校大学生的约占70%,在校大学生是大学生犯罪的最主要受害对象。这就是说,探寻和研究在校大学生成为刑事犯罪被害人的自身因素和规律,进而针对性地制定和落实大学生犯罪被害预防的措施,以减少或克服大学生的犯罪被害性,也是实现有效预防和遏制大学生犯罪的重要途径。
