村民委员会换届选举问题探究——以日照市第十届村民委员会换届选举工作为例.pdf

摘要

本文将《中华人民共和国村民委员会组织法》(以下简称《村组法》)新修改完善后的
村委会换届中的有关问题作为主要研究和讨论的内容。修订后的《村组法》于二○一○年十
月廿八日由全国人大常委会表决通过并颁布实施。十多年来,我国农村社会发生了翻天覆
地的变化,城乡二元的户籍制度在这种影响深远的变革的促动下,也开始逐步地出现松动
和变化,农村税费改革的步伐也在快速迈进。在总结十多年来全国各地优秀的村民自治实
践基础上,全国人大常委会对《村组法》进行了必要的修改和完善。
这次修改和完善将全国不同地区逐步摸索出的进一步完善村民自我管理、充分行使民
主权利的好探索、好创新,用法律条文进行了确认,使其具有更广泛的指导性和可操作性。
但是,从《村组法》修订之后日照市进行的第十届村委会换届选举的情况来看,有些问题
并没有如期望的那样得到有效的解决。本文着重针对这些问题进行原因分析并提出建议,
并为今后《村组法》的进一步修改提出意见,以促进其更加的完善。
本文共分四部分:第一部分介绍规范村委会换届的法律、法规和文件;第二部分对日照
市第十届村委会换届的基本情况进行简要的介绍;第三部分列举了《村组法》修改完善后,
日照市第十届村委会换届工作中出现的问题并较为详细地分析了其原因。第四部分针对日
照市第十届村委会换届选举中出现的问题,根据分析出的原因,有针对性地提出逐步解决
这些问题的对策,对《村组法》以后的修改和完善提出了相关意见和建议。

Abstract

This article mainly studies the problems in the villagers’ committee election after the latest
revision of the mittee Constitutive law, which was promulgated and implemented
on October 28, 2010, by the mittee of the National People Congress. In recent ten
years, tremendous change has happened in rural society of our country. Urban and rural binary
census register system is gradually being broken, and the reform of rural taxes and fees is being
pushed ahead fast. At the conclusion based on the practice of excellent villagers' autonomy all
over the country in recent ten years, the mittee of the National People Congress
voted through the revision of the mittee Constitutive law.
This revision cures and deepens the experiences and practices explored by different part of
the country to protect villagers exercising their democratic rights in the form of law, making its
guidance and operability more and more extensive. However, looking from the result of Rizhao’s
10th villagers’ committee election after the revision of the mittee Constitutive law,
some of the problems are not solved effectively. This article mainly focuses on the analysis of the
problems and puts forward suggestions for further revision of the mittee
