我国刑事和解制度法律问题的规制与思考

内容摘要
2012年3月随着新刑事诉讼法获得通过,新修正的《中华人民共和国刑事诉讼法》更是将《当事人和解的公诉案件诉讼程序》单独列为一章,为公诉案件进行和解提供了明确的法律依据和制度支撑。但刑事和解制度作为一新生事物是否能在中国这一土壤上正常生长,在实际运用中能否防止刑事和解制度被滥用,这一问题得到了法学界的关注。本文将以新刑诉法的具体规定为基础,分析如何防止在实践运用中对刑事和解的滥用,提出刑事和解法律监督的制度构建以及关于刑事和解成了在宽严相济刑事司法政策中新兴的刑事案件处理机制,较好地实现了被害人、加害人、国家及社会利益的契合,对于化解社会矛盾、促进社会的和谐有着积极的意义进行论述。
