南京师范大泰州学院商学院本科毕业论文国际贸易中专利标准化壁垒的应对浅析 1 国际贸易中专利标准化壁垒的应对浅析摘要:随着知识经济的到来与全球化的发展,知识产权对经济及贸易的影响越来越大。专利,作为知识产权的重要组成部分,在其产生之初并没有考虑限制国际贸易或投资。但是,在传统关税壁垒不断被限制的情况下,拥有专利技术优势的国家为了维护其在全球的利益,开始利用专利构建一些符合国际规则的专利标准化壁垒,并通过专利制度将标准化壁垒不停地向更高级的方向发展。中国作为贸易大国,对于专利标准化壁垒越来越显得难以应付。我国自身也需要符合国情的专利保护制度以促进国内自主创新的发展。因此,对我国所面临的与专利技术有关的贸易和投资壁垒进行深入的研究并探讨如何建设中国的专利制度以应他国专利标准化壁垒就成为本文写作的初衷及希望解决的问题。关键词:专利;专利标准化壁垒;应对 STUDY ON PATENT BARRIERS TO TRADE AND COUNTERMEASURES Abstract: In the age of knowledge economy and globalization, the impact of intellectual property rights on economy and trade is ever-growing. The patent isone of important part of intellectual property, and is very important to innovation. It does not mean to restrict international trade and investment at the beginning. But in the situation that petition is fierce and traditional tariff barriers and non-tariff barriers to trade have been limited and regulated, the developed countries and panies with technical superiority began to use patents asa reasonable and lawful tool to build barriers to trade. In order to safeguard their interests all over the world and maintain the leading edge of technology and profit, the developed countries and panies developed and advanced the form of patent-related barriers to trade through patent scheme and trade policies and try bine of patents protection with trade.
