商业拆迁法律问题分析研究.pdf

南京航空航天大学硕士学位论文 I 摘要目前,随着我国市场经济的持续快速发展和城市化进程的加速,城市房屋拆迁所引发的纠纷正日益引起社会的关注。我国城市房屋拆迁中,商业拆迁所占比重较大,且在商业拆迁领域中产生的矛盾尤为尖锐。由于我国在城市房屋拆迁法律制度上长期将商业拆迁和公益拆迁混为一谈,商业拆迁始终遵循行政强制拆迁的模式,对公民的财产权造成极大的危害,而新近颁布的《物权法》虽然规定基于公共利益可以征收个人房屋,但并未解决商业拆迁中存在的问题。此外,商业拆迁的相关法律制度尚不完备。故本文将研究方向定位于商业拆迁,通过对现行商业拆迁中存在的问题进行探究,意在找寻相关对策,完善商业拆迁法律制度,最终解决商业拆迁中存在的矛盾,保障被拆迁人的利益和城市建设平稳进行。本文首先从学理的角度对商业拆迁的产生、发展,运作模式,法律关系进行阐述,并重点分析商业拆迁和公益拆迁的区别;其次,通过不同角度观察“钉子户”事件,以此对商业拆迁的现状进行探究,并找出存在的主要问题;再次,比较和借鉴国外有关商业拆迁的案例和运作模式,总结经验,为完善我国商业拆迁制度提供参照;最后针对目前的问题,从完善立法、约束行政权、建立平等谈判机制、保障司法救济等方面提出完善商业拆迁制度的具体措施,用以指导今后商业拆迁工作,使商业拆迁还原为真正的市场交易行为。关键词: 商业拆迁,公共利益,商业利益,权力,权利商业拆迁法律问题研究 II Abstract At Present, with the persisting and quick development of market economy and acceleration of urbanization process of our country, the dispute ca used by the resettlement of urban building is gradually absorbing society’s attention. In the resettlement of urban building, the proportion of business resettlement account for a lot and the conflict caused by business resettlement is very sharp. Because of the mixture between business resettlement monwealth resettlement in the law of urban building resettlement of our country, the business resettlement always follows the mode of pulsion resettlement, which causes a great loss for citizen’s possessions. Although the newly enacting Property law regulate the collection of personal building for the public profit, the new law do not solve the problem existed in business resettlement. Beside, the related law of business resettlement is not prefect. Therefore, orientation to the business resettlement, the essay is to look for the solution and prefect the business resettlement regulation by researching on the problem existed in business resettlement, finally solving the conflict of business problem and ensuring the profit of resett
