摘要摘要自从20世纪我国提出科教兴国战略口号以来,我国的教育事业有了极大的发展,与此同时,学生群体的规模也呈现几何增长。伴随着学生群体的扩大以及学生生活的日益丰富,其中的一些摩擦也与日俱增,由此带来的便是各种校园伤害事件层出不穷。此所谓前有马爵爷怒杀室友,后有民工甲屠戮幼儿,甚至还有一些学生殉情自杀。为此,学校背负的着巨大的压力。但是我国对于校园伤害事件纠纷解决机制规定略为简单,完全不足以应对盘根错节的案情。在国际上,很多国家都建立的系统的纠纷解决机制,其中包含当事人和解、诉讼调解、诉讼程序、仲裁程序等等。而在我国,《侵权责任法》和《学生伤害事故处理办法》上有对于未成年人在教育机构侵权事件的处理办法,但仍然略显空洞,没有成为一个系统的对未成年人学生的保护的法律体系。因为法律上的空白,所以一直未能给双方一个满意的解决办法, 以至于民众都怠于通过法律手段维护权益,反而愿意通过上访、闹事等极端方式。基于学生伤害事故纠纷问题的社会意义和法律意义的重要性,本文试图以《学生伤害事故处理办法》为切点,探讨其中不足之处,以及如何完善学生伤害事故纠纷中校方责任的认定与追究的相关法律问题,以有效地打击违法犯罪,维护好受害学生及家庭和学校的合法权益,切实维护社会主义法治秩序。关键词:学生伤害事故:归责原则;伤害鉴定 Abstract Abstract Since the 20th century,China through science and education strategy slogan, China’Seducation hasbeen agreatdevelopment,and atthesame time,the sizeofthe student groups geometric with the expansion of the student population,as well asstudent ing richer,some frictionisalsoincreasing, thisbrings is avariety ofcampus damage event SO-called before there Ma Ferguson killed the roommate after migrant workers a killing young children,and even some students sentimentalism thisend,the school bear tremendoLIS our campus incidents involving injuries dispute resolution mechanism requiring somewhat simpler,is totallyinadequate todeal withthemerits ofthedeep·rooted.
