河北大学硕士学位论文道德的法治价值姓名:徐秀娟申请学位级别:硕士专业:伦理学指导教师:高春花 20070601 摘要摘要作为调节人类社会秩序的两种规范系统,道德与法律的社会作用缺一不可。依法治国,必须充分重视道德的应有价值,这既是克服法律有限性、事后性之不足的需要,也是建设法治国家的客观要求。所谓法治是按照法律治理国家的政治主张,它是一个由立法、执法、司法和守法构成的动态过程,道德在其中发挥着独特的作用。正义作为道德原则之一,它指导着立法。立法的宗旨是创立一种能给社会带来福利与和谐的社会秩序,它以完善道德(正义)为目标,以基本的道德准则为基础,涵盖了自由、平等、诚信等道德理念;正义要求执法者在法定的程序里进行操作,而执法主体所具有的道德品质是执法正义的重要因素,不仅如此,执法者还必须具备良好的职业道德素质,这是确保法律得以实施的重要条件;正义不仅是立法的宗旨,执法的重要道德原则,它也是司法的美德,是司法的本质要求。在司法过程中为了实现和维护正义,司法主体必须具备良好的道德品质;社会成员的守法心态需要道德制约,全体公民的道德意识是守法的重要保障。惟其如此,在法律运行的各个环节,必须充分重视道德的应有价值。现代法的创制必须发挥道德在立法中的价值,要以正义为基本价值取向,维护自由, 体现平等,注重诚信;要加强执法主体道德建设;培育司法主体职业道德,提高全体公民道德素质,从而为法律的有效运行提供坚固的道德支撑和价值导向,确保依法治等诚信法律信仰 Abstract Abstract As two standard systems ofregulating theorder ofhuman society,morality and law are thecountry by law,we must pay attention tothevalue ofthemorality.
