当代中国法医鉴定体制研究——以与日本法医鉴定体制比较视角.pdf

内容摘要法医鉴定体制作为我国司法鉴定制度的重要组成部分,在法庭科学领域及现代诉讼中发挥着同益重要的作用。近年来,我国法医鉴定体制中机构设置的合理性、鉴定人的资格等问题同益突出。由于受到传统定式思维和司法鉴定体制现状的限制,法医鉴定体制的系统改革始终未能得以全面铺丌。本文试图通过介绍当代我国法医鉴定体制的演变与特点,并以与F1本法医鉴定体制比较的视角,针对我国现行法医鉴定体制中存在的弊端,就法律、体制、管理等多方面进行探讨分析,并认为在当代中国适宜构建一个在新公共管理和实验室质量管理体系基础上的一元化的多层级的法医鉴定体制。论文分为引言、J下文和结论三部分,其中正文共分四章。第一章介绍当代中国法医鉴定体制的演变过程及特点,主要通过对我国法医鉴定体制发展三阶段的分类,就法医鉴定体制在这三个阶段的演变与特点进行陈述,以期做一全貌了解,为架构我国新型法医鉴定体制做一事实铺挚。第二章介绍当代中国法医鉴定体制存在的问题,主要剖析了法律法规、体制、管理等几方面存在的问题,以便加以改善、解决。第三章介绍同本法医鉴定体制,通过比较的视角,就法律法规、体制、管理等方面进行比较研究,考察两种法医鉴定体制的区别,并借鉴F1本法医鉴定体制的长处对构建我国新型法医鉴定体制做一必要补充。第四章是本研究的目的与重点,通过对新公共管理理论及实验室质量管理体系概念的引入,就我国法医鉴定体制改革中所涉及的法律、鉴定管理制度、鉴定机构设置、鉴定人资格、鉴定标准的修订等内容逐一梳理,从而导出一个在此基础上的新型的一元化法医鉴定体制。【关键词】法医学鉴定司法鉴定体制鉴定机构鉴定人【中图分类号】C939 Abstract ForensicMedicinesystem as ourjudicial system ofidentifying animportant part of theTribunal inscience and modem litigation andplay an increasingly important recent years,China‘S forensic medicine institutions inthe establishment of rationality,identify the eligibility ofpersons and other traditional pattern thinking and judicial identification system status,forensic medicine institutionalsystem reform has not been able article attempts to introduce contemporary China’S forensic institutional changes and characteristics, and tothe Japanese parative perspective,in view of the existing forensicmedicine inthesystem ings inthe legal,institutional and management andexplore many aspects,and thatincontemporary China suitable for building anew publicmanagement andlaboratoryqualitymanagement system based on thebasisof thelevelofforensicexamination system.
