公安行政强制措施分析研究.pdf

内容摘要公安行政强制措施问题不仅关系到行政相对人的切身利益,也关系着行政职权的有效行使。目前,《行政强制法》正在研究制定之际,行政强制措施理论成为研究的重点,我已经有了很大程度的提高,但是关于公安行政强制措施的研究仍然不够深入,实践中仍然存在很多问题。本文从理论出发,结合公安行政执法的实践,以寻求公安机关在行政强制措施上的实践操作问题和立法缺陷问题。文章首先从行政强制的基础理论入手,在对行政强制、行政强制措施、公安行政强制措施三个概念进行剖析之后,就公安行政强制措施的概念、分类及其特点作了梳理与明晰。在解决最基本的问题后,文章在理论论述的基础上,进一步分析了公安行政强制措施在立法和执法方面的缺陷。最后,基于前三部分的分析与思考,文章对完善我国公安行政强制措施法律制度提出构想,包括完善相关立法、确立公安行政强制措施的适用原则、强化条件限制、规范实施程序等,以便对实践有更为重要和直接的指导意义。关键词:行政强制公安行政强制措施研究中图分类号: 公安行政强制措施研究 Abstract The issueof Public Security pulsory Measure not only relates toimmediate interests oftheadminstrator himself but also involving in ,pulsory Law isbeing formulated,the theory of Security Administrative Enforcement Measures es thekey whole levelof reseach have greatly improved,we didn’tthoroughgoing reseachwork inPublicSecurity Administrative Enforcement Measures,there are stillmany on theory bined withactionofactivitiesofpublicsecurity lawenforcement,the dissertationexplores operative problem and legislative pulsory measures.
