论我国反兹断执法机构摘要摘要反垄断法是市场经济的基本法律,有“市场宪法"之称,是市场经济法律体系中不霹缺少的重要部分,它对市场经济的确立以及维护自由、公平、有序、良好的竞争秩序起到重要的保障作用。然而反垄断法本身并不能够创设一个公平翻由的市场环境,它的有效实施离不开一个独立、高效、权威的反垄断执法机构。而我国的《中华人民共和囡反垄断法》只是规定我国的反垄断执法机构实行国务院反垄断委员会十国务院反垄断执法机构的二元执法模式,并没有明确具体的指明我国的反垄断执法机构到底如何设置。按照现有的制度设计,我国的反垄断执法将维持以前的各部门分散执法,而根据我国国情,反垄断执法机构需要独立、权威、并能够集中行使职权。针对这一问题,本文将“我国反垄断执法机构”作为研究课题,试图通过对我国现行反垄断执法机构的分析以及对二元执法模式的质疑来探寻一条适合我国国情的反垄断执法机构确立和完善之路。关键词:反垄断法执法机构构建和完善作者:骆忠玲指导老师:冯兵 Research on theAnti—monopoly Law Enforcement Agencies China Abstract Research on theAnti--monopoly Law Enforcement Agencies inChina Abstract To protect free and petition order,anti-monopoly law is one ofthebasic laws tomodem market economy,and itsessential function operates efficiently is depending on thelaw enforcement ,anti-monopoly lawitselfcan not bethe creation of afreeand fairmarket environment,it call not beseparated from the effective implementation of allindependent,efficient and authoritative antitrust law -monopoly lawjust adopts theAnti·mittee andthe StateCouncil’S anti-monopoly law enforcement agencies(double enforcement model)to fulfillanti—monopoly law,which does not stipulate clearanti-monopoly law enforcement accordance withtheexisting design ofthesystem,China's anti-monopoly lawenforcement willmaintain theexisting statusquo,but according to China’S national conditions,anti-monopoly law enforcement agencies need to be independence,authority and beableto concentrate on response to this problem,this article defines‘'the anti—monopoly law enforcement agencies of our country’’as itstopic,an attempt by theanalysis ofChina's current anti—monopoly law enforcementagencies硒well asthechallenge ofdouble enforcement model tofind a suitable way to construct andimprove our country’S anti—monopoly lawenforcement agencies.
