兰州人学硕士学位论文行政决策法治化理性构建的案例分析摘要行政决策法治化的理论基础在于法律对行政的控制,目的是通过宪法和法律来规定和约束决策主体的行为和决策过程,保障广大人民群众的利益,并使决策权力受到监督。行政决策法治化,是建设法治政府的本质内涵,是行政决策科学化和民主化的保障,是政府行为法制化的基本内涵。行政决策法治化,贯穿于行政决策的整个过程,分为四个阶段:行政决策问题的认定、行政决策的制定、行政决策的执行、行政决策的监控与调整。此外, 行政决策的主体和客体也是行政决策过程中不可或缺的重要角色,因此,行政决策法治化的理性构建分为五部分来论述,每部分选取一个典型案例,具体为:重庆“最牛钉子户"事件,论述了行政决策法治化过程中行政决策主体与客体的关系;厦门PX项目事件,论述了行政决策问题的认定中公民有效参与行政决策和公民权利的保护;东莞“禁猪"风波,论述了行政决策制定过程中行政决策听证与行政指导的运用;北京限制养犬政策的执行,论述了行政决策执行有效性的实现;乐清“广场政治",论述了行政决策调整与监控的相关问题。通过对五个案例的分析,来探讨行政决策法治化理性构建过程中的问题或借鉴意义,在此基础上,提出行政决策法治化理性构建的相应对策。关键词:行政决策行政决策法治化理性构建兰州丈学硕士学位论文行政决策法治化理性构建的案例分析 Abst ract Administrative decision-making ofrulingby lawislimiting and restricting the subject of administrative decision·-making and administrative decision·-making process through theConstitution and thelaw inorder toprotect theinterests ofthe people and make the decision-making power under theoretical basis liesinthe control ofadministrative isthe nature of building the government ofruling by law and the protection ofmaking the administrative decision—making isalsothebasic content ofthe legal system ofthegovernment’S actions.
