TheCivil liability of the Third Party Infringes Upon Spouse Rights A Thesis Submitted to Chongqing University in Partial Fulfillment of the Requirement for the Professional Degree By ChenXiaoli Supervised by Specialty:Juris Master College of Law of Chongqing University, Chongqing,China April,2014 重庆大学硕士学位论文中文摘要 I 摘要对于社会上出现的“情妇”、“小三”、“二奶”等问题,人们往往只是给予行为人不利的道德评价而已。而从行为人所造成的后果来看,其侵害了他人的配偶权,造成他人合法权益的损害,理应承担相应的法律责任。因此,本文从保障受害配偶利益角度出发,剖析第三者侵害配偶权民事责任的理论基础,并展开论述民事侵权责任的构成要件。较为简单因果关系不是本文论述的重点,本文着重论述第三者侵害配偶权行为的认定、责任主体与归责原则、财产责任与非财产责任,以此分别体现行为、过错、损害要件,完整论证第三者侵害配偶权的民事责任。本文共分为七章,第一章和最后一章分别为引言和结语。第二章为配偶权与共同侵权责任理论。本章重点剖析配偶权的核心内容,揭示配偶利益的核心为情感与性的专一性,得出配偶相对关系内的施害配偶与配偶关系外第三者共同侵害他人的核心配偶利益。第三章为第三者侵害配偶权的行为认定。本章罗列了第三者侵害配偶权的具体表现,指出该类行为的侵权性质,并从主体、违法性、损害、因果关系及行为方式五个方面分析行为的构成条件。第四章为第三者侵害配偶权的责任主体与归责原则。本章分述了不同情况下的责任承担主体,并构建了以过错推定为归责原则,以故意缺失、受害配偶同意为免责事由的第三者侵权责任归责体系。第五章为第三者侵害配偶权的财产责任。财产责任包括精神和物质两方面的损害赔偿责任。为切实保障实现补偿意义,提出完善个人专有财产制,建立非常财产制,明确赔偿所得的归属。第六章为第三者侵害配偶权的非财产责任。本章指出非财产责任的具体形式以及特殊情形下的适用。关键词:第三者,配偶权,过错推定,财产责任重庆大学硕士学位论文英文摘要 II ABSTRACT For the problemsuch as "mistresses", "small three","ernai" that appear on society, people tend to just give the actor bad moral evaluation. But judging from the consequences caused by the actor, someone’s spouse rights which are the lawful rights and interests were infringed,the actor should bear the corresponding legal responsibility. Therefore, this article from the perspective of protect the interests of victims spouse, analyzing the theoretical basis of civil liability of the third party infringes upon the spouse rights, and discussing the constitutive requirements of civil tort liability.
