新型城镇化背景下的农村土地制度的分析研究.pdf

摘要摘要“三农”问题是中国最主要的问题之一,而农民最为关切的问题则是耕地问题。自这一问题提出并作为研究对象以来,农地制度一直是人们关注和争论的焦点所在。中华人民共和国成立后,中国大陆土地制度经历过几次较大规模的变革。迄今为止,家庭分散经营的联产承包责任制已成为中国耕地安排最典型的特征。现行的农村土地制度起源于上个世纪七十年代末期的经济体制改革,是在保留原有的耕地占有的基础上将部分产权落实到户。实践这个制度以后,农民的生产积极性得到了前所未有的释放,粮食生产总量迅速提高,绝大部分农民在短期内解决了吃饭问题。同时它还有力地支持了中国的现代化和乡镇工业的建设,使一些农民踏入了致富的道路。然而,现阶段的耕地安排也有一些难以克服的缺陷,如耕地产权模糊不清, 相关法律和政策体系有待重建;耕地流转困难,现代化的农业规模生产步履维艰等等。以上耕地安排的不足,不仅增加了农村的不稳定因素,甚至拉大了中国城乡社会的差距。特别是在目前阶段加速发展,新型城镇化已经成为经济建设的巨大推动力的关键时刻。本篇文章基于统筹城乡的角度,在对城镇化和耕地制度的历史和事实分析与总结的基础上,得出了农民利用土地作为生产要素参与城市发展,是缩小城乡差距的重要手段,也是推进新型城镇化战略的重要途径。通过比较土地国有化与土地私有化等改革方案,认为当前阶段最佳途径是坚持和完善农地集体所有制度, 农地制度改革的重点应放在做实农地的物权,明确界定所有权、充分稳定承包权、有效搞活使用权、切实保护农民土地收益权,促进新型城镇化建设的顺利展开, 并对农地改革的相关配套制度进行尝试性的构建。关键词:新型城镇化;农地制度;城乡统筹;问题 Abstract ABSTRACT ”Three ruralissues”is China’Sbiggest problem,and thebiggest problem is the the”threerural”problems and 2LStheresearch object,research on theruralland system has been thefocus ofitsattention and the founding ofthePRC,China’S landsystem hasexperienced severaltimes oflarge scale change,SO far,to”team asthebasis,all three”of the household contract responsibility system e themost distinctive feature ofChinese ruralland system.
