万方数据 I 摘要本文首先在收集资料和实地调研的基础上分析安徽省现行征地补偿标准实施情况,包括征地补偿相关政策、补偿标准的确定方法以及调研样本区的实际征地情况。其次透过征地利益相关主体的视角来分析现行征地补偿标准实施过程中存在的问题,整合利益相关主体对征地补偿的利益诉求。重点对安徽省征地补偿标准进行重构。现行征地补偿标准计算方法主要有年产值倍数法和区片价法,虽然区片价法比年产值倍数法更科学,但仍基于被征土地的原用途进行补偿,并不能保障农民的长远生计。本文引入土地估价方法,在继承、推广区片价的基础上对区片价标准进行改良并创新重构。在重构过程中切实考虑被征地农民对土地增值收益、社会保障补偿等合理诉求,尽可能保证重构标准的公平合理性。最后本文在重构区片价的基础上结合利益相关主体的利益诉求建立征地补偿标准动态调整机制,从调整幅度、调整周期和调整内容等方面为安徽省改革现行征地补偿制度提供参考。同时从四个方面讨论了今后如何更好地开展土地征收工作:严格依法依规征地,切实维护农民权益;缩小征地范围,控制征地规模;科学制定征地补偿标准,给予被征地农民足额补偿;多途径安置失地农民。关键词:安徽省;征地补偿;区片价重构;动态调整机制万方数据 II Abstract This paper analyzes the basis of the collected data and field research on the c urrent compensation standard implementation of Anhui Province, including the meth od of determining compensation for land acquisition policy, compensation standards for land acquisition and actual research sample area.
