摘要摘要法院附设诉前调解,是在构建和谐社会的大背景下产生的新型纠纷解决机制,是传统纠纷解决方式与现代司法资源的优化整合。论文第一章首先阐明法院附设诉前调解是指纠纷由当事人起诉到法院之后,法院受理之前,或在纠纷起诉之前,由当事人自愿选择或者法院依职权,将纠纷交由附设在法院的诉前调解组织进行调解:进而分析诉前调解在本质上属于诉讼外调解,具有尊重当事人程序选择权、有利于保护当事人系争外利益、有利于缓解法院压力节约法院资源、有利于双方当事人和谐解决纠纷等价值和功能。论文第二章对美国、日本和我国台湾地区的法院附设诉前调解相关制度进行考察、总结和归纳,以期对我国实践产生有益的借鉴意义。论文第三章在对我国诉前调解开展较典型的上海市浦东新区法院、上海市长宁区法院、常州市新北区法院、苏州市吴中区法院附设诉前调解实践考察的基础上,厘清当前附设诉前调解实践中体现出的优势和及具体存在的问题。文章最后一部分针对实践中存在问题,提出应合理设置诉前调解机构、扩展附设调解机构类型、明确受案范围、规范调解启动程序、充分发挥兼职调解人员作用,对法院附设诉前调解机制予以完善。关键词:附设法院诉前调解民间调解 Abstract Abstract Pre·litigation court-annexed mediation,is a new dispute resolution produce in the background of building a harmonious society,which optimizationed traditionaldispute resolutions andmorden judicial resources.
