我国金融服务市场开放中的市场准入问题的分析研究.pdf

摘要加入wTo后,我国参加的WT0的各种协定的具体要求已经成为我国囤内法的有机组成部分,同时我困在金融领域的具体承诺已经具体化、明确化。出于我国现有的法制及市场规则在很大程发上仍保留了由计划经济向市场经济体制转轨的诸多特征,金融法制的基本原则和内容尤其是WTO最为关注的市场准入具体规则与WTO法律制度的要求还有差距。因此,为了切实地履行入世之后的各项义务, 并努力维护自己的合法权益,我困有必要对WTO法律框架下的市场准入制度进行深入研究,并及时地按照有关要求对我困觋自+的金融法律制度进行变革。本文从对WTO规则中的市场准入制度尤其是金融市场准入制度的研究着手,并与我国入世议定书中的相关具体承诺和现有金融法律体系相结合,分析我国入世承诺及相关法律制度的不足和漏洞,其中着重对金融服务中的三个最主要的服务部门即保险、银行和证券市场的准入问题进行研究,并分别对它们的市场准入法律制度的完善提出笔者的一些建议。关键词: 世界贸易组织金融金融服务市场准入 ABSTRACT Aft er enteri ng the WTO,the sPeci fi c requo st s of a】l agFeement s that Chi九a haS parti cipated i n haye been Part S 0l' our natiOn’S internal law,and aL the same time,our specifi c promi Se s i n the fie1 d 0f financial Servi Ce haVe been c』ear.
