r《、t1437781分类号:—— U DC:——密级;——编号:——法学硕士学位论文和谐社会中律师职业道德研究硕士研究生指导教师学位级别学科、专业所在单位论文提交日期论文答辩日期学位授予单位:王梅生:林国建教授:法学硕士:思想政治教育:人文社会科学学院:2008年4月:2008年6月:哈尔滨工程大学哈尔滨工程大学硕士学位论文摘要律师业是为各种社会主体提供全面法律服务的专门职业,在和谐社会中有权利保护、经济效益、社会稳定、辅佐管理i文化促进等作用。因此,律师职业素质与职业道德水平的高低,将直接影响律师行业的发展,影响社会的公平与正义,影响社会主义和谐社会的建设。本文共分四个部分。第一部分是绪论,笔者阐述了本文将在和谐社会的背景下,立足前人研究的基础,对律师职业道德建设做创新研究。第二部分阐述了和谐社会与律师职业道德的基本内涵,独有特征;并进一步阐述了加强律师职业道德建设对构建和谐社会的作用。第三部分介绍了我国律师业职业道德缺失的若干表现:思想道德上重利轻义、社会公德的忽视与缺失、法律服务中恶性竞争、个人素质滞后、职业纪律放纵。并对律师业职业道德缺失的原因进行了深入分析:是少数律师在思想观念上缺少职业荣誉感、价值取向上利益重于责任、法律制度漏洞给律师违法提供可能、对违法办案的律师惩罚力度不够、律师执业规范体系不完备不健全等。第四部分从确立符合构建和谐社会要求的律师职业道德理念、探索律师职业道德教育的科学体系、健全律师职业道德建设的相关制度、注重和谐社会背景下的律师自教自律四个方面,提出了有针对性的对策建议。关键词:律师;律师职业道德;和谐社会哈尔滨工程大学硕十学位论文 ABSTRACT Lawyer profession is aspecialjob that can provide fulllawservice forall kinds ofsocietysubject,and plays allimportant roleinrightprotection,economic benefit,society stability,aidmanagement andcultureprogressing inharmonious ,the lawyer’Sprofession quality andthe levelofprofession ethicswilldirectly exert influence onthedevelopment oflawyer profession, socialfairjustice and the construction of aharmonious society.
