1 论夫妻财产制(西南科技大学网络教育学院法学 2010 春) 内容摘要: 在社会主义市场经济条件下,夫妻对其财产的处分直接关系到夫妻在家庭中的地位和家庭的稳定,也关系到市场经济的健康发展。婚姻家庭关系是身份关系与财产关系的统一,夫妻间的财产关系,是婚姻共同生活不可或缺的物质基础和保障,也是夫妻关系的核心。因此,夫妻财产的相关事项须事先以夫妻财产制加以规范,夫妻财产制集身份法与财产法的特定于一身,是婚姻效力的一项重要法律内容,也是近现代家庭财产制的重心所在。本文就夫妻财产制的相关概念,结合《婚姻法》及三个司法解释进行了论述,体现了夫妻财产制在婚姻家庭及社会稳定中的重要性。关健词: 夫妻财产制法定财产制约定财产制 2 On the matrimonial property regime Wang Yu Man ( Southwest University of Science and work Education College of Law Spring 2010 ) Content abstract: Inthe socialist market economy, the couple disposition oftheir property isdirectly related tothe status ofhusband and wife inthe family and family stability, but also tothe healthy development ofthe market economy.
