土地流转背景下农民社会保障问题地研究.pdf

I 摘要随着经济和城市化的发展,大量的土地流转了,一方面推动了我国经济发展;另一方面也产生了大量的土地流转农民。土地是农民的命根子,一旦被流转,农民生产和生活受影响,不得不从事其它职业。由于我国存在着城乡二元体制结构的影响,农民被排斥在社会保障体系这一公共产品之外,同时,又因为我国现行的土地流转制度不健全, 导致了诸多土地流转农民“种田无地、社保无份、创业无钱”的境地,致使他们的生存权和发展权受到威胁,他们的社会保障问题已经成为社会的热点问题和棘手问题。 文章首先写的是土地流转农民社会保障现状研究,五保保障对土地流转农民来说不在范围之列、家庭保障脆弱、生育保障有限和土地保障乏力。资金不足,资金来源要多元化,加强资金的管理和监督,防范基金风险。其次写土地流转农民社会保障问题表现, 指出社会保障体系不健全,多头管理,水平低下,资金不足,城乡二元体制结构影响等不足。第三,具体分析了土地流转农民社会保障问题有七个残缺的原因。第四,通过对英国、美国和德国等西方国家社会保障制度的分析,笔者得出启示,认为建立社保政府要承担责任,重视社保立法,建立与我相适应的土地流转农民的社会保障制度,资金来源多元化,共同承担风险,同时注重家庭保障。最后文章提出了土地流转农民社会保障应对之策,这是文章的重点。认为应该建立土地流转农民社会保障制度,在最低生活、养老、医疗、教育就业培训和法律援助等几个方面着手解决,最终目标是建立城乡一体化的社会保障制度。 关键词:城市化,土地流转农民,社会保障 III ABSTRACT With the economy and urbanization development, large quantities of land circulation in China, on the one hand, promote the economic development; On the other hand also generates a lot of land circulation farmers.
