论司法参与下的人民陪审员制度

[摘 要]随着我国法治建设的快速推进，司法改革逐渐深入，要求司法民主的呼声不断增强。由于肩负着实现司法民主重任的人民陪审员制度没有发挥其应有的作用，因此改革现有的人民陪审员制度是现实所需。结合十八届四中全会的指导精神和司法改革的现实需要，本文通过对当下人民陪审员制度存在的问题进行总结，再从存在机理和必要性对其制度进行分析，接着从立法和实践两方面对其现状作出分析。最后立足于对人民陪审员制度综合把握的基础上，完善司法参与下的人民陪审员制度，以期为实现司法民主贡献一点力量。
