摘 要
夫妻财产制是调整夫妻财产关系的一项重要的法律制度，在婚姻家庭立法中具有极为重要的地位，不仅直接关系到夫妻共同生活和整个家庭生活的物质条件，影响婚姻家庭的团结和睦，而且对稳定社会秩序也有着重要的作用。修正后的《婚姻法》首次确立了夫妻个人特有财产制，构建了婚后所得共同制、夫妻约定财产制、夫妻个人特有财产制“三制”并存的夫妻财产法律制度，必将对新形势下的夫妻财产关系、婚姻家庭关系产生深远影响。但新的夫妻财产制仍存在立法疏漏，本文试图在通过分析我国现行夫妻财产制缺陷的基础上，提出进一步完善我国夫妻财产制的全面、具体的设想,使夫妻财产制内容科学、体系完整、操作性强，更好地调整夫妻财产关系。

Abstract
Marital property system is to adjust the relationship between husband and wife property is an important legal system, in the marriage and family legislation plays an important role, not only directly related to couples living together for the whole family life and the material conditions of marriage and family, the influence of the unity of the peace, and to stabilize the social order also have an important role. Revised marriage law established the first couple personal characteristic property system, and constructs the common marriage system, system of couple's agreed property, couples personal peculiar system "SanZhi" of both husband and wife property legal system under the new situation, be sure to husband and wife property relationship, marriage and family relationship a far-reaching influence. But the new husband and wife property system still has legislative omissions, this article tries to through the analysis of China's current marital property system defect presented, based on the further perfect our country's husband and wife property system of comprehensive and specific ideas, make the husbands and wives property system content science, system complete, practical strong, better adjustment of husband and wife property relationship.
