羁押必要性审查制度研究

【摘要】 修改后刑诉法增设了羁押必要性审查制度，有利于打破之前“一捕了之”的实践困局，防止超期羁押和不正当关押，尊重和保障人权。羁押必要性审查既具有诉讼监督的性质也具有准司法审查的特点。基于诉讼模式及诉讼价值侧重点的不同，两大法系主要法治国家在羁押必要性的审查方式、适用程序等方面存在一定差异。完善羁押必要性审查制度，有必要借鉴两大法系国家的成功做法与经验，明确羁押必要性审查的主体、启动模式、审查内容与方式、效力等事项。
