刑法没有直接规定运输假烟是一种犯罪行为；运输烟草制成品或假烟的行为也没有列入、包括在其他有关的罪名中——因此我们不能主观的、自由的延长犯罪行为打击链条。 营运是一种经营，但营运不是专营，它没有列入国家垄断经营、统一管理的范畴。营运与烟草、食盐的专卖、专营是完全不同的。 目前我国对于烟草专卖、专营的许可仅仅限于生产行为、批发行为、零售行为——运输烟草的车辆与企业无需取得专营许可，也无法取得专营许可。
