摘要 IIHllJJllllJlfllflMJJJlll Y2290709 网络交易与传统交易不同的是,在网络市场上的网络交易中消费者的信赖和认可对于网络交易的繁荣和发展具有十分重要的影响。我国虽然制定了《消费者权益保护法》等法律来加强和完善在传统交易市场上的法律保护,但对于我国发展较为迅速的网络交易方面的消费者权益保护并不充分。而在美先进、经济发达的地区,他们已经较早的形成了完备的网络交易市场,并制定了较为完善的法律保护规则,对网络交易已经较早的制定了比较完整的法律保护体系。本文参考和借鉴了这些发达国家的发展和立法经验并在深刻分析我国国情的基础之上,从以下四个部分总结出我国在这方面的立法的完善。第一部分,以世界网络交易的产生和发展为背景结合我国对网络交易的理解,总结网络交易的概念并深入分析网络交易的形式和网络交易的特性,在这样的基础上研究网络交易在我国的发展历程、我国对网络交易法律的发展沿革和我国在网络交易安全权方面存在的不足。第二部分,由于欧盟、美国、日本和韩国的网络交易发展已经成熟并且已经形成较为完善的法律体系,因此在这里主要介绍这些国家的发展历程和法律发展沿革,这些国家的社会发展和思想方式都不一样,这些国家的法律也各具特色。第三部分,从消费者的隐私权、经营者相关信息披露、交易双方的公平交易等方面的主要发达国家的先进立法规定如美国的自律模式、信息披露义务,欧盟的先前信息权等,学习这些国家的在网络交易安全权方面的做法。第四部分,从以上我国网络交易的发展历程和国外先进的立法经验为基础,深入分析总结出我国在完善网络交易安全权立法监管的构想,对我国一部分网络交易法律进行一定的补充和修改,主要是在信息披露、格式合同条款、退货权方面的完善和增加,从而形成具有中国特色的法律保护体系。关键词:网络交易;知情权;隐私:立法 ABSTRACT The trade work and thetraditional transaction different,work trade consumer market on inthe trust and recognition has very important influence on theprosperity and development work OUtcountry hasformulated the”consumer protection law”and other laws tostrengthen andimprove thelegalprotection inthetraditionalmarket,but theprotection of consumer rightsand interests forChina's relatively rapiddevelopment work transaction not the United States,Japan,EU and otherinformation technology advanced,economically developed regions,they needle hasearlierformed workmarket,and setup the ruleoflegal protection on work more perfect,has earliermade plete legal protection thispaper,with reference tothe development ofthese developed countries andlegislative experience and onthebasis ofdeep analysis ofthesituation ofour country,summarize theperfect our legislation inthisaspect from thefollowing fourparts.
