每个具体业务种类面临的政策及法律限制市场发展水平及其需求各不相同本论文选取两种在业务开发中具有典型意义的业务种类外汇信托和房地产投资信托进行了具体研究目前国内的个人外汇投资渠道很少试点的几个外汇信托产品的热销证明了外汇信托市场需求极大监管部门正有意提供条件允许所有信托公司开展此项业务因此信托公司要采取对策抓住政策放宽的机遇房地产投资信托在国际上发展较为成熟以美国为典型房地产投资信托对我国的房地产业和证券市场的发展能起到积极作用也存在市场需求具有一定的可行性但是我国整体市场环境不成熟缺乏配套的法规和制度不能推出与国外完全相同的信托产品因此信托公司应加强研究吸取国外经验结合我国实际推出满足市场需求的产品通过两种不同开发思路的对比目的是探讨信托公司开发业务种类的一般规律即进行业务开发时必须注重考虑市场环境和法律环境并由此采取不同开发策略对市场及需求成熟但目前政策法规限制了其发展的业务种类信托公司要现在就着手进行研究开发做好及时推出信托产品的准备对虽然受法规及政策的限制但主要受市场环境不成熟缺乏与之配套的法规制度和工具的限制的业务种类信托公司应该有所作为研究发达国家的经验开发出适合我国现阶段市场的信托产品我国信托业务比起第五次治理整顿前有了很大发展但和国外成熟的市场相比层次仍然很低因此应对信托业务的发展充满信心关键字信托投资公司业务种类开发外汇信托房地产投资信托 THE EXPLORATION OF BUSINESS TYPES DEVELOPMENT OF CHINA’S TRUST & PANIES ABSTRACT The environment that China’s trust & panies are facing is analyzed in the first part of this the fifth liquidation and rectification, 55 panies survived and got the new registration, and a new trust industry formed. The “Trust Law”, “The Managing Rules for Trust Companies” and “The Temporary Managing Rules for Money Trust business of panies” which enacted during the fifth liquidation and rectification will not only help the trust industry in the lawful and standard course of development but also describe a strict supervision over the trust industry. Compared with that of 2000 when the liquidation and rectification started, the market environment has changed a lot. In the developed counties with a market economy, the trust industry is regarded as one of the four pillars of financial industry including banking, securities, insurance and trust. There are advantages for trust industry over other financial industries. In this article, the types of panies’ business are divided as two categories and then are discussed indetail. The first category is the trust business with the meaning of “managing money for client under trust” which was seldom developed before the fifth liquidation and rectification. And this category can be divided as sub-categories including money trust business, investment
