天津大学硕士学位论文我国招标投标法律制度的经济分析姓名:赵娜申请学位级别:硕士专业:管理科学与工程指导教师:张水波 20080501 中文摘要招标投标已经成为我国建设工程市场的主要交易方式,在改善经济秩序、提高投资效益方面发挥积极作用的同时,在推行中也存在不少问题,如规避招标、串通招标等等。制度的不完善、不配套造成了招标投标法律制度的作用并不十分明显。本论文的研究目标是以新制度经济学的基本理论为基础,从制度成本和交易成本两方面入手,分析我国招投标法律制度对工程招投标成本的影响,探究我国招投标法律制度效益低下的原因,研究如何从成本角度完善我国招投标法律制度,以期为招投标制度改革提供理论参考。本文首先借鉴吸收新制度经济学的理论研究成果,并结合建设工程招投标自身特点,界定了建设工程招投标成本结构。其次,通过对建设工程招投标法律制度的成本收益分析,深刻剖析了我国建设工程招投标成本的特点。通过研究发现, 立法成本投入不合理,导致招投标法律制度本身存在缺陷,法律冲突严重。配套制度不健全以及各种寻租活动致使法律运行成本过高,导致法律实施困难,从而影响招投标法律制度功能的发挥。因此,虽然招投标制度本身具有很明显的经济效益和社会效益,但是由于工程招投标成本结构不合理,导致招投标制度没有得到很好的实行,严重影响了招投标的实际效果。因此,应该从成本的角度加强对我国招标投标法律制度的研究和完善,法律效益的度量也应该以工程招投标的成本为主要标准。本文为我国招标投标法律制度的研究提供了一种成本的视角和新的研究思路。关键词: 招标投标交易成本法律成本法律收益 ABSTRACT Tbnde血g and bidding isⅡ1emajor栅lsaction metllod inme constrIlction eI培inee血g market.
