辽宁省城镇企业职工企业年金试行办法

第八条 企业年金方案和修改方案应经职工代表大会讨论通过。
第九条 企业年金方案应包括以下内容：
（一） 参加人员范围；
（二） 资金筹集方式；

（三） 企业缴费划入职工个人帐户办法；
（四） 基金管理方式；
（五） 享受条件；
（六） 支付形式；
（七） 组织管理和监督程序；
（八） 约定的其他事项。
第十条 企业年金方案按隶属关系报劳动保障行政部门备案。
第三章 企业年金资金筹集
第十一条 企业年金可由企业为职工缴纳，也可由企业和职工共同缴纳。其中，企业每年缴费一般不得超过本企业一个月的平均工资，个人缴费额不超过企业缴费划入本人帐户的数额。企业和职工具体缴费比例通过集体协商的方式确定。

第十二条 企业缴费在年工资总额4%以内的部分，在企业成本中列支。超过年工资总额4%的部分，在企业职工福利费或自有资金中列支。
第十三条 企业缴费向职工个人帐户分配资金时，可综合考虑职工的岗位、贡献、本企业工作年限等因素确定，适当拉开档次，但每年最多不得超过五个月的本企业平均工资。
第十四条 企业年金采取按月缴费方式，职工个人缴费由所在企业代扣代缴。企业
