“人权保护〞的路径——即天赋的人权相对于其他法益具有最高地位。
然而，在一些特殊的紧急避险案例中，需要权衡的同为生命权——由此出现两个问题：首先，2人的生命是否比1人的生命更有价值〔生命的价值是否可以量化〕？其次，如果生命权之间的价值无法进行权衡，又如何确定法律对事件的评价？
最后，通过案例分析，我们可以看到“人的尊严〞的保护，作为不同于“人权〞保护的另一种路径，在确立法律内部价值体系的构成中具有特殊的核心地位。
