“人权保护”的路径——即天赋的人权相对于其他法益具有最高地位。
然而，在一些特殊的紧急避险案例中，需要权衡的同为生命权——由此出现两个问题：首先，2人的生命是否比1人的生命更有价值〔生命的价值是否可以量化〕？其次，如果生命权之间的价值无法进行权衡，又如何确定法律对事件的评价？
最后，通过案例分析，我们可以看到“人的尊严”的保护，作为不同于“人权”保护的另一种路径，在确立法律内部价值体系的构成中具有特殊的核心地位。

主题报告：行政审批与合同效力关系探讨

2009年，云南红塔集团〔以下简称“云南红塔”〕与陈发树签订《股份转让协议》，%的云南白药的股份以22亿元的对价转让给陈发树。《股份转让协议》还约定：协议自签字之日起生效，股份转让事项须报相关国有资产监督管理机构审核批准后方能组织实施。
陈发树于合同签订后5日内即向云南红塔支付了22亿元，但时至2011年底，陈发树仍未能实际取得该部分股权。因此，陈发树将云南红塔告上法庭，要求确认《股份转让协议》合法有效；判令被告云南红塔全面继续履行《股权转让协议》；,744,；判令被告云南红塔赔偿截至2011年12月8日的总损失并承担案件一审受理费〔1697万元〕。2012年12月28日，云南省高院作出判决，确认《股份转让协议》合法有效
