试论海商法的调整对象

提 要 我国是世界十大航运国之一，远洋运输在我国对外贸易中占居重要位置。1993年7月1日起生效的?中华人民共和国海商法?，是近年来我国所公布的法律中与国际惯例和国际通行做法接轨最多的法律之一。明确海商法的调整对象，有利于加强对海商法的研究。本文论述了海商法的四方面调整对象：海上企业组织、海上商业运输、海上损害赔偿和船舶担保法。

海商法一词包括了两层含义，一是指作为法律的海商法，如?中华人民共和国海商法?，?英国海上货物运输法?等等；二是指海商法学科，即以海商法为主要研究对象的古老的法律学科，一般又称为海商法学。本文从第一种含义上使用海商法一词，即本文所研究的是海商法法律的调整对象，而且主要以1992年11月7日第七届全国人民代表大会常务委员会第28次会议通过的?中华人民共和国海商法?为根底来研究海商法的调整对象。
海商法一词在大陆法系国家称为Maritime Law或The law of Admiralty，在英美法系国家称为Shipping Law。从词源上考查，海商法一词是与“海〞和“商〞有关的法律，是有关海洋商业的法律。海商法的调整对象各国学者认识不一，各国的立法实践也多有相异之处，这除了与法律传统、文化习俗、航运习惯等有关之外，还与一个国家的地理位置、外贸地位等有关。我国海商法体系是以?中华人民共和国海商法?为核心，以?中华人民共和国对外国籍船舶管理规那么?、?中华人民共和安
