中华人民共和国中医药法
(征求意见稿)
第一章 总 那么
第一条 为了继承和弘扬中医药，保障和促进中医药事业开展，保护人体健康，制定本法。
第二条 本法所称中医药，即中国传统医药，是我国各民族医药的统称，是反映中华民族对健康和疾病的认识、具有特定理论和中华文化特征的医学体系。
中医药是我国医药卫生体系的特色和优势，是国家医药卫生事业的重要组成局部。
第三条 国家实行中西医并重的方针，充分发挥中医药在医药卫生事业中的作用。
第四条 开展中医药应当遵循其自身规律，建立符合中医药特点的管理制度。坚持继承和创新，保持和发挥中医药特色和优势；坚持统筹规划，促进中医药全面协调开展；坚持中医西医相互学习，鼓励西医学习中医，促进中西医结合。
第五条 国家鼓励和支持社会力量投资中医药事业，采取措施支持组织、个人捐助中医药事业。

第六条 国家鼓励和支持中医药对外交流与合作，促进中医药的国际传播和应用。
第七条 国家开展中医药文化，将中医药文化建设纳入国家文化开展规划。
每年10月11日为“中医药日〞。
第八条 国务院中医药主管部门负责全国的中医药管理工作。国务院其他有关部门在各自职责范围内负责与中医药管理有关的工作。
县级以上地方人民政府中医药主管部门负责本行政区域内的中医药管理工作。县级以上地方人民政府其他有关部门在各自职责范围内负责与中医药管理有关的工作。
第九条 县级以上人民政府应当建立中医药工作协调机制，统筹解决中医药事业开展中的重大问题。
第十条 对在中医药事业开展中做出突出奉献的组织、个人，按照国家有关规定给予表彰、奖励。
第二章 中医药效劳
第十一条 开展中医药预防、保健、医疗、康复效劳，应当以中医药理论为指导，运用中医药技术方法。
第十二条 国家建立覆盖城乡的中医药效劳体系，保障公民享有接受中医药效劳的权益。
