　　第三条 招标、拍卖或者挂牌出让、公正和诚信的原则。
　　第四条 工业、商业、旅游、娱乐和商品住宅等经营性用地以及同一宗地有两个以上意向用地者的，应当以招标、拍卖或者挂牌方式出让。
　　前款规定的工业用地包括仓储用地，但不包括采矿用地。
　　第五条 国有建设用地使用权招标、拍卖或者挂牌出让活动，应当有计划地进行。
　　市、县人民政府国土资源行政主管部门根据经济社会发展计划、产业政策、土地利用总体规划、土地利用年度计划、城市规划和土地市场状况，编制国有建设用地使用权出让年度计划，报经同级人民政府批准后，及时向社会公开发布。
　　第六条 市、县人民政府国土资源行政主管部门应当按照出让年度计划，会同城市规划等有关部门共同拟订拟招标拍卖挂牌出让地块的出让方案，报经市、县人民政府批准后，由市、县人民政府国土资源行政主管部门组织实施。
　　前款规定的出让方案应当包括出让地块的空间范围、用途、年限、出让方式、时间和其他条件等。
　　第七条 出让人应当根据招标拍卖挂牌出让地块的情况，编制招标拍卖挂牌出让文件。
　　招标拍卖挂牌出让文件应当包括出让公告、投标或者竞买须知、土地使用条件、标书或者竞买申请书、报价单、中标通知书或者成交确认书、国有建设用地使用权出让合同文本。
　　第八条 出让人应当至少在投标、拍卖或者挂牌开始日前 20日，在土地有形市场或者指定的场所、媒介发布招标、拍卖或者挂牌公告，公布招标拍卖挂牌出让宗地的基本情况和招标拍卖挂牌的时间、地点。
　　第九条 招标拍卖挂牌公告应当包括下列内容：
