东营市土地经营管理暂行办法

　　第六条纳入储备的土地，按照下列标准进行补偿：
　　(一)新增建设用地和用于公共设施及其他公益项目的存量划拨用地，按《东营市土地统一征用办法》规定的征地标准补偿。
　　(二)用于其他项目的存量划拨土地按照下列标准进行补偿：
　　1、土地出让前支付补偿费用的，按政府公布地价的30%补偿；
　　2、土地出让后支付补偿费用的，按成交地价的30%补偿。
　　(三)破产企业使用的原划拨土地无偿收回，地上建筑物及附着物按照国资管理部门认定的评估价补偿。
　　(四)收回出让土地按下列标准补偿：
　　1、出让期限未满的，根据开发利用程度和余期年限给予相应补偿；
　　2、无力开发又不具备转让条件的，按原出让价格补偿。

第三章土地供应
第七条供应土地应当按下列方式办理：
　　(一)招标、拍卖、挂牌出让方式
　　商业、旅游、娱乐和商品住宅等各类经营性用地，必须以招标、拍卖或者挂牌方式出让；其他用途的土地，在供地计划公布后，同一地块有两个以上意向用地者的，也应当采用招标、拍卖或者挂牌方式出让。
　　(二)协议出让方式
　　1、原划拨土地使用权人保持原用途办理出让手续的，可以办理协议出让手续；
　　2、原划拨土地使用权人将非经营性用地改为经营性用地，按照城市规划要求不需要重建且利用原有房地产的，可以协议方式补办出让手续；按照城市规划要求需要重建的，
