内容摘要
我国《婚姻法》规定了无效婚姻制度与可撤销婚姻制度,这两种制度都是对不具备
结婚实质要件的违法婚姻进行规制。无效婚姻制度针对的是违反公益要件而缔结的婚
姻;而可撤销婚姻制度则是针对违反婚姻私益要件而缔结的婚姻,且仅仅只有胁迫婚这
一中情形为可撤销婚姻,但是在胁迫婚之外还存在欺诈婚姻这一情形受欺诈方意思表示
也存在瑕疵,同样也是对婚姻自由原则的违反,然而婚姻法却未对欺诈婚进行规制,这
对于受欺诈方的婚姻自由权保护是极为不利的,因此,我国有必要对欺诈婚姻进行法律
规制。
本文除引言外共分为四个部分进行论述。从分析欺诈的内涵开始,引入欺诈婚姻的
界定,分析规制欺诈婚姻的必要性,在考察国外相关立法后,认为宜将我国欺诈婚姻认
定为可撤销婚姻。
第一部分对欺诈与欺诈婚姻进行界定。首先,从民法中“欺诈”一词的含义为出发
点展开论述,介绍民法中欺诈行为的效力,然后界定欺诈婚姻的含义、构成要件,并将
欺诈婚姻与相关概念进行比较分析。
第二部分分析对欺诈婚姻进行法律的现实必要性。这部分以案例为基础,分析认为
对欺诈婚姻进行法律规制为解决实务中的案件提供法律依据,完善我国可撤销婚姻制
度,保护善意当事人和第三人利益有着非常重要的意义。
第三部分分析介绍域外对欺诈婚的立法态度。两大法系由于各自的立法体例不同,
对欺诈婚姻的态度不尽相同,但都对欺诈婚姻的效力进行规制,不管是将其认定为无效
婚姻还是可撤销婚姻,都体现了该国对欺诈婚姻的一个基本观点即不赞同欺诈婚姻,对
其持否定态度;然后对欺诈婚姻被宣告无效或撤销之后的法律后果进行比较分析。
第四部分介绍对我国法律规制欺诈婚姻的建议。我国应将欺诈婚姻认定为可撤销婚
姻,在分析这样做的原因后介绍撤销权人,撤销权行使的方式、期限等,另外特别介绍
一方以虚假身份进行结婚登记的欺诈婚姻处理方法,希望对我国婚姻法的完善有所建
议。

Abstract
China's "marriage law" provisions of the invalid marriage and revocable marriage
system to judgment the marriage effectiveness which is not satisfy the effective elements. The
invalid marriage system is aimed at those marriages which violate the public elements; and
the revocable marriage system is aimed at the marriages which are in violation of the
private elements. The revocable marriage system only contains forced marriage, because
the intimidated party's declaration of will has some ings in a marriage relationship
which violate the principle of the freedom of marriage. In addition to forced marriage, the
fraud marriage also violate the principle, while the laws without making rules and regulations
to govern the fraud marriages. This omission is not conducive to the protection the rights of
