仅仅规定行政行为的范围、条件、幅度和种类等，由行政机关根据实际情况决定如何适用法律而作出的行政行为的权利。
　　对于这一定义，本人感觉制定得较为抽象，给行政主体留下自由裁量空间。这是行政事务的复杂多变性导致的。这就是说行政主体在一定范围内可以随意设程序壁垒，或侵犯法律赋予公民的权益，或加重公民的行政法义务，从而轻易摆脱法律的控制和约束，使行政权变为压制公民的专制工具。
，助长了自由裁量权的滥用。我国法治起步较晚，人们法律意识淡薄，利用法律武器保卫自己的利益和尊严的意识尚浅。民怕官、不敢告、不愿告、不会告的“病症〞相当突出，这无形中助长了自由裁量权的滥用。

　　行政自由裁量权运用得当的专业性、技术性因素进一步增多，使行政管理更趋复杂。因此，愈来愈多的行政管理领域需要行政主体根据客观实际情况，在法律原那么指导之下，由自己理性判断并对其加以灵巧裁量。
　　行政自由裁量权是克服法律滞后性和成文法局限的需要。由于行政事务的广泛复杂性和人们认识在制定法律法规时，不可能对于行政活动的每一环节都作详尽无遗的全面标准。
　　制衡机制对行政自由裁量权的标准
　　所有的这些都清楚的告诉我们一个事实，那就是行政自由裁量权应该标准而不是放弃，应该从程序、行政主体，行政相对人以及司法变更权对其限制机制的健全等方面入手解决。
司法变更权的存在就是为了限制自由裁量权的权利过大，及时纠正那些显失公正的行政处分。然而作出行政处分的行政机关总是强调法律赋予的自由裁量权来排拆司法变更权,而人民法院那么认为行政处清楚显失去公正量权的限制。
另外，行政程序的规制，也同样可以监督行政权合理运行。行政程序一旦设定并法律化后，行政主体必须遵循程序之规定，按照程序规定的方式、方法和步骤去作为，否那么就要承当违反程序之法律责任。行政程序规定了行政相对人的程序权利，制约了行政主体的程序权力。
