摘 要
中药的专利保护是知识产权保护模式中的一种,自我国《专利法》实施以来,中药专利保护取得了明显的效果,但现阶段中药专利出现流失和被抢占的现象,专利侵权难以认定,极大危害了我国中药行业的可持续发展。针对以上种种问题,积极完善我国中药专利保护法律体系、制定现代专利保护制度、强化重要专利的技术和管理刻不容缓。基于此,本文选择了中药专利保护作为研究对象。
本文除导论和结论外,共由四部分组成。第一部分是中药专利保护概述,先是简要介绍中药的概念和保护范围,然后介绍现阶段中药专利保护现状,阐明了中药专利保护的意义。第二部分是我国中药专利保护中的问题分析,这部分先从中药专利保护所存在的问题入手,紧接着通过比较分析继而探索出为何中药专利保护困难,会带来何种危害。第三部分是国外传统医药专利保护经验的借鉴,这部分通过介绍国际 TRIPS 协议、美国、德国、韩国、日本,印度和欧洲专利局等国家或组织关于中药专利保护的规定,在比较法上对中药专利保护进行分析,继而得出利于我国中药专利保护制度的一些借鉴。第四部分就健全我国中药专利保护提出了具体建议和对策,包括四节:第一节为完善中药专利保护的基本制度,第二节为强化中药专利保护制度与其他保护制度的协调,第三节为建立中药专利保护的专门机构,第四节为加强中药的专利保护意识。

Abstract
Patent protection of intellectual property protection of traditional Chinese medicine is a model. Since our "Patent Law" implemented, Chinese patent protection achieved remarkable results. But loss of and seize Chinese patent, hard to identify patent infringement, that greatly endanger the sustainable development of traditional Chinese medicine industry. To solve the above problems, it ought to actively improve the legal system of traditional Chinese medicine patent protection, the development of modern patent protection system, strengthening important patented technology and management imperative. Based on this, I choose the medicine patent protection as research subjects.
In addition to summary and conclusion, the research paper has four parts. The first part is an overview of traditional Chinese medicine patent protection, first briefly introducing the concept and scope of protection of traditional Chinese medicine, after focusing on the status of patent protection, last describing the significance of traditional Chinese medicine. The second part is problem analysis of traditional Chinese medicine patent protection, this part starting with the problems, followed by parative analysis and then exploring the reasons for the difficulties of patent protection, last elaborating medicine brought poor hazards.
