商业银行的资本充足率是银行信用的表征长期以来我国国
有商业银行资本充足率并不高却以高度的政府信用作为替代
政府成为银行亏损风险的最终承受者银行资本未受到足够重视
随着 WTO 市场规则的适用和外资银行的进入重构我国国有商业
银行与政府的关系提高资本充足率已经成为必要的选择针对这
种情况银监会于 2004 年出台了商业银行资本充足率管理办法,
正式引入巴塞尔资本协议 8﹪的最低资本要求本文着重从法律维
度探析国有商业银行资本充足率的现状意义以及提高资本充足率
的途径
第一章是商业银行资本充足率概述资本是能使价值增殖的财
产商业银行资本由自有资本与债务资本构成债务在特定情况下
可以成为资本由于存在国家资本与私人资本的区别国有商业银
行资本充足率并非越高越好应该在保持商业银行足够流动性的基
础之上维持资本充足率的合理水平
第二章指出我国国有商业银行资本充足率现状不容乐观造成
国有商业银行资本充足率不足的原因一是国有商业银行的特殊地
