灭火救援法制现状研究
摘要
2008年《消防法》的修订,标志着我国的消防法制建设发展到了一个新的阶段。在新《消防法》中,确定了公安消防部队参加重大灾害事故和其他以抢救人员生命为主的应急救援工作的法定职责,进一步推进完善了灭火救援法律体系。然而,在整个消防法制建设中,与消防监督管理方面的法制建设相比,我国灭火救援方面的法制建设相对滞后,内容不够全面,缺乏可操作性,而且法律层级较低,不能满足社会日益发展的需求。本文通过分析我国灭火救援法制建设的现状,认为我国灭火救援法律体系不完善,法制层级低,灭火救援缺乏法制化,灭火救援应急预案不规范,以及战后总结制度,预警制度,灭火救援损害赔偿和补偿制度不完善等一系列问题。要完善我国的灭火救援法制,主要是完善灭火救援法律体系,提高法规层级,加强灭火救援法制化,规范灭火救援应急预案以及完善战后总结制度,预警制度,灭火救援损害赔偿和补偿制度的建议,以推动灭火救援法制建设,规范灭火救援行为,保障灭火救援行动顺利开展。

The Research Directions of the Fire Fighting and Rescue Legal System
Abstract
As the amendment of the Fire Control Law in 2008, the construction of fire control legal system in our nation has reached a new level. In the new Fire Control Law, the responsibility of fire fighting unit in major disasters and in other rescue work aimed to save human lives is confirmed, and the fire fighting and rescue legal system is pleted. However, in the entire construction of fire control legal system, compared to the construction of fire surveillance legal system, the construction of the fire fighting and rescue legal system is undeveloped and unestablished, lacks of feasibility, and is in a low level, which can not meet the need of the development of the society. By analyzing the current state of the construction of fire fighting and rescue legal system in our nation, this paper points out several problems: 1 law system of fire fighting and rescue is pleted; 2 legal hierarchy is low; 3 fire fighting and rescue is not put on a legal basis; 4 contingency plan of fire fighting and rescue is non-standard; 5 the pleted systems of early warning, pensate, etc. In order to solve these problems, it is necessary to promote the construction of fire fighting and rescue legal system, to heighten the legal hierarchy, to put fire fighting and rescue on a legal basis, to standardize the contingency plan of fire fighting and rescue, and plete the systems of early warning and pensate.
