摘要
中医药品贸易已经成为我国在国际贸易中不可或缺的一部分,但是由于中医药知识产权保护制度的不完善,在国际竞争中我国落于下风。严重损害了我国利益以及国内企业利益。希望通过本文课题的论述,不仅能够提高企业或者配方拥有者对于中医药品保护重要性的认识,通过法律途径对中医药品知识产权进行保护,而且也希望本文的论述能够为以后我国中医药品知识产权保护体系的建设提出可行对策。本课题的研究内容主要分为以下几个方面:第一部分主要阐述了中医药的定义和特征。第二部分阐述我国主要的几种中医药品保护形式;第三部分探讨中医药品知识产权保护的现状以及存在问题,由于我国是迫于国外压力才开始重视知识产权制度的建设,所以我国现在的中医药品现状不容乐观,可所谓是漏洞百出。主要是从立法方面深入分析,寻找问题出现原因;第四部分分析国外对于中医药品知识产权保护的先进经验,国外立法比较完善,政策体系完整;第五部分提提出解决中医药品知识产权保护对策,结合国外的先进经验,结合我国实际国情,提出可行的对策建议。

ABSTRACT
