刑事诉讼中的强制证人作证问题研究
中文摘要
我国新修改的《刑事诉讼法》中,增加了强制证人出庭作证制度,这一制度的确
立是为了解决我国司法实践活动中长期存在的证人出庭率低的状况。证人出庭作证对
查明案件真相,保障诉讼公正具有很重要的意义,而在长期实践中,证人作证制度仅
仅存在于法律文本之中。为了最大程度地实现法律的公平正义,法律规定了强制证人
出庭作证制度,其目的是为了改变司法现状,实现法律目的。在确立这一制度的同时,
为了促使这一制度发挥作用,法律同时对证人经济补偿、证人保护等制度作出了规定,
在立法层面上对强制证人出庭提供了支持。但是法律在这一问题上的规定过于笼统,
仍然存在着很多不足之处。本文意在通过对法律条文的解读,指出法律中的问题,并
提出相关意见促进这一制度的完善。

Abstract
Forcing the witnesses to testify in court system has been increased in newly Criminal
Procedure law. The establishment of this system is in order to solve the long-standing
situation that the attendance of witnesses during judicial practice activities is low.
Witnesses testify in court has a very important significance to identify the facts of the case
and safeguard the procedural justice. But in the long-term practice this system just being in
legal texts. In order to achieve the fairness and justice of the law maximum, change the
Present Situation of Justice and achieve the legislative purpose, to force witnesses to testify
in court system has being provided. During establishing this system, in order to promote
this system play a role, pensation of witness and protection of witness
system has being provided in law to provide support for the witness system at the
legislative level. However this modification is still too general and has a lot of
inadequacies. By interpreting the legal provisions, finding the deficiencies of the law and
putting forward advices to promote the improvement of this system in this paper.
