若干国家传统医药知识保护的实践及其启示

摘要:传统医药知识保护及其利益分享,是亟待解决的问题。本文分析了国际社会通过公约将传统医药知识
作为集体人权进行保护和津巴布韦、印度、老挝、菲律宾等国在保护传统医药知识上的做法。认为:印度以政府
大力支持,民间组织积极运作,全面调查传统医药知识并进行收集归档,建立风险基金和孵化器的机制;老挝以
政府主导,建立专门机构传统医学研究中心来保护传统医药知识的做法;菲律宾以制定全面保护传统知识特别
是传统知识中的财产权的法律制度进行立法保护。这些有益的经验值得我们借鉴。

Abstract: The p rotection of traditional medicine knowledge and its benefits sharing are the p roblem s that should be
solved instantly. The essay analyzes that the international society p rotects traditional medicine knowledge as the collec
tive human rights through international conventions. It also analyzes the p ractices of Zimbabwe, India, Laos and Philip
p ines. The results shows that: the Indian government supports greatly, and the non - anizations actively
carry out the register and documentation of traditional medicine knowledge, and sets up the national venture funds and
the incubator mechanism; Laos establishes a anization ( the TraditionalMedicine Research Center) to p rotect
