The so-called floating populationhas higher crime rate because of many reasons, how to enforce law equally in them and protecttheir legal right is atough issue in the enforcement of criminal procedure law. Takebailfor instance, the applicable rate is very low in floating population, because the suspect or defendant can not provide enough bail moneyor qualified guarantor. However, That the principle of bail prevails while detention is an exceptionhas not fullybeenestablished, so it is hard to apply bail in floating population. This dissertation researched the legal issues of bail applicationin floating populationwith the methods of empirical studyand put forward some suggestions. The whole paper consists of four partsas below: the first part is a brief introduction. As it is the beginningof paper, this part introduces the background, the main content and the meaning of this research. The second part is empirical studyof W City. This part takes some realdata and analyzes these data from different perspectivesand maintainsthat as an easterncity with mass floating population, the low applicablerate of bail in criminal procedure hindersthe floatationpopulationenjoyingequal rights, though W City takes some innovativemeasures but these measures alone cannot addressthefundamental problems appropriately. The third part is the problemsmanifestedin the application of bailon the floating populationin W City. This part analyzes the reasons in the application of bail in W city and maintains that the problems onconceptualleveland in specification levellead tothe difficultiesof application of bail.
